We received a survey this week from the USDA (FORM NACS-01).  It starts off with a cover letter stating that the National Agricultural Classification Survey (NACS) is required by law.  If you do not reply, you may be personally visited or you may receive a telephone call.  The form states that a response is required by law.  However, nowhere does it indicate what law you will be breaking if you do not respond.  The entire document is carefully worded to make it seem as though you are required to answer all of their questions. 

 

The questions include items such as if you have received any agricultural income in the last year, how much land you own, if you have any fruit, berry or nut crops, how many vegetable or melon crops you have, if you have a nursery or a greenhouse, if you have bee hives, cattle, hogs, pigs, sheep, lambs, goats, kids, horses, ponies, mules, donkeys, burros, chickens or turkeys and if so, how many, if you have internet access or high speed internet access.  They also want to know the ethnicity and sex of the people who run the operation.

 

Personally, I don't think any of it is their business.  We finally decided we will send it back with a question as to what law we will be breaking if we do not answer the questions.  After all, a question is a response.  Therefore, I would think we will be in compliance.  Even during the census all they are allowed to ask you is how many people live in your home.

There is a play with words, which may lead many to believe they are required to comply. However.... No where can I find any law/code listed that requires a response, or the information requested.

I believe the following could be adapted for this application.

My response to the 2010 Census long form was;

According to the Constitution of the United States, Congress has authority to count the number of persons for the apportionment of representatives for Congress. Neither Congress nor the Census Bureau has the constitutional authority to request information beyond the number of people that reside at this address. The number of people who reside at the address noted above is __, and this number is included on the form provided. Any other personal information requested is not required for census, and would be used for purposes other than is specified by the Constitution of the United States.

Person’s residing at this address cannot be compelled and not under constitutional obligation to provide answers to personal questions not relevant to the constitutional purpose of census. Answers to questions not required by the Constitution are protected by the Constitution, and therefore have not been answered.

If evidence can be provided that any question not answered on census form is constitutionally required, please provide evidence, and answers will be provided.

My reply to the census was 5 "others" and then I wrote American on the line.

We "may" do this.  We "may" do that.

When the government uses the word "may" they are usually lying.

How can they prove that you received their notice unless they sent a return receipt certified letter? Ignoring them always works. Always remember, we need NOT ever answer a question or questionnaire from government agents. If they send another copy, do likewise. If they come to visit, remember what the attorney said. Don’t answer the door. If caught outside, ask them to read the Miranda Warning to you because you intend to not speak with them. In other words, reply like you had a traffic stop issue.  Remember the video?  As Michael and Ms Graves said, stand up for yourself.  A few dry rehearsals makes this easier to perform.

Oh, I have never had any issues with standing up for myself.  :-)  We do have a small egg business.  Or I should say we did.  So, I can see how they could have gotten our names.  I am not answering any of their questions.
